ملخص
هدفت الدراسة إلى التعرف على أهداف الضبط ا لإداري (الأمن العام، السكينة العامـة، الصحة العامة، وعناصر أخرى كالمحافظة على البيئة والآداب العامة ).
ولقد استخدمت الدراسة المنهج التحليلي من خلال عرض نصوص المواد الدستورية والقانونيـة وتفـسيرها وتحليلهـا وصولاً إلى الغاية التي أرادها المشرع من وراء هذه المواد ، وقد حرص ت على الاطلاع علـى مجموعة كبيرة من المراجع والكتب التي تناولت موضـوع سـلطة الـضبط الإداري عمومـاً وتطبيقاتها في دولة الكويت خصوصاً منها ذات العلاقة بالموضوع .وقد توصلت الدراسة إلى نتائج عدة، من أبرزها: أن المشرع الكويتي قد أقر حق الإدارة في استعمال وسا ئل الضبط الإداري لغرض جمال الشوارع ورونق الطرقات، كما أن المـشرع الكويتي حرص على إنشاء هيئة متخصصة في شؤون البيئة من أجل الارتقاء بالبيئة الكويتيـة، وأن المشرع الكويتي قد بين أن أهداف الضبط الإداري تنحصر في مجال الأمن العام والسكينة العامة والصحة العامة، وأن مسؤولي الضبط القضائي هم من يقومون بسلطة الضبط القـضائي في الكويت، وأن القضاء الإداري في دولة الكويت استقر على إخضاع أعمال الـضبط الإداري للرقابة الإدارية .وقد أوصى الباحث بضرورة الأخذ بنظام اللامركزية الإقليمية فيمـا يتعلـق بالـضبط الإداري باعتبارها مكملة لنظام المركزية ليتحقق في النهاية تنظيم أعمال الضبط الإداري
Administrative Regulation in Kuwait Student name: Abdulmajeed Al Muteri Doctor: zuher qadoraAbstract This study aimed to identify the objectives of administrative control (public security, public order, public health, and other elements such as the preservation of the environment, and morals). The study used the analytical method through the presentation of the texts of constitutional and legal provisions and interpretation, analysis and access to the purpose intended by the legislator behind this material, has been keen to see the wide range of references and books on the subject of the authority of administrative control in general and its applications in the State of Kuwait, especially the ones related the subject. The study found several results, most notably: that the Kuwaiti legislature has recognized the right of management in the use of means of administrative control for the purpose of beauty of the streets and luster of the roads, and the Kuwaiti legislature was keen to establish a specialized body in the affairs of the environment in order to improve the environment of Kuwait and the Kuwaiti legislature may between the objectives of administrative control is limited to the area of public security and public order, public health, and judicial officials are carrying out the authority of judicial officers in Kuwait, and that the administrative court in the State of Kuwait settled on the subject of administrative control of management control. The researcher recommended that the introduction of regional decentralization with respect to exactly the administrative and stay away from the central system to organize the work of administrative control.
